1. APPLICATION
1.1 These terms of delivery are applied to the services of Jama Works Oy.
2. SERVICES AND WORK PERFORMANCE
2.1 What is considered service or work performance are all instances of Jama Works Oy delivering the customer workers, equipment, work applications, etc. for the completion of a job.
2.2 Jama Works Oy collects a mileage tax (0,57€/km) of driven work trips when agreed upon with the customer.
2.3 Invoicing proceeds upon charges notified to the customer.
2.4 Jama Works Oy obeys Finnish laws and regulations in all operations.
The customer has the right to cancel an order of work performance as long as the cancellation is made 24 hours before the due date for said work. Provided that the work performance is canceled within 24 hours of the due date, Jama Works Oy holds the right to charge compensation for the capacity reserved for the work in question equal to a five-hour charge. Furthermore, provided that, the work performance is canceled had it already begun, Jama Works Oy holds the right to charge compensations for the time spent working and a five-hour charge seeing the capacity reserved.
2.5 Provided that the customer subcontracts Jama Works Oy to work outside the appointed work that has been agreed upon within the order or another matter complicating the execution of commission, Jama Works Oy holds the right to charge the extra work in question separately.
3. WORK SAFETY
3.1 Provided that the addressed work performance has a reason to take notice of any apparent work safety, should the customer notify Jama Works Oy of said occurrences before the commence of work performance.
3.2 Provided that Jama Works Oy employees notice work safety endangering factors they hold the right to suspend current work performance immediately.
3.3 Jama Works Oy obeys occupational safety laws as well as working time laws in all operations.
4. RECLAMATIONS AND DAMAGE LIABILITY
4.1 If the customer's personal property is broken or damaged during work performance or service by Jama Works Oy, the customer must file a written reclamation to Jama Works Oy within 7 (seven) days. Damage to customer property must be reported within a reasonable time, principally within two weeks. If this has not been done, Jama Works Oy is free of liability.
4.2 Jama Works Oy employees and the customer must be able to clearly individualize the incident (accident/grave carelessness) which has led to property or material damage. Provided that two-sided individualization cannot be given, the accident is out of the circuit for reparation.
4.3 Jama Works Oy damage charges are in all cases limited to two times the wage paid by the customer.
4.4 Jama Works Oy damage charges can decrease or be acquitted in the event that the accident can be proven to have been caused by the following:
- The customer has postponed the moval of furniture or the appropriate protection of property and/or furniture.
- Protection and packing of furniture and property is the customer's responsibility unless agreed upon differently.
- The condition of movable furniture does not possible moving it following normal caution.
- For example the bad condition of furniture or improper assembly. The furniture is vulnerable to changes in temperature or moisture, such as plants or special furniture.
- An electronic device has no apparent exterior damage during the followed assignment.
5. INVOICING TERMS
5.1 Work performance and services are invoiced according to an agreement partly before, completely before, or after the work performance.
5.2 Payment condition is net 14 days.
5.3 Penalty interest in each case a penalty interest verified by the Bank of Finland.
5.4 Jama Works Oy reserves the right to change unit prices according to the changes in market and expense situations.
6. OTHER TERMS
6.1 Change in address is to be notified to Jama Works Oy without delay.
6.2 Provided that while checking possible credit rating it becomes clear that the customer has a Note Default, Jama Works Oy can require the customer collateral security for securing the payment claim.
6.3 Differences in opinion regarding these terms of delivery are aimed to be solved through discussion. In the event of not finding a common ground regardless of efforts, matters will be taken to Helsinki district court.
